1. Who we are

Our online store is powered by Shopify. These Terms, together with our Privacy Policy and our Returns & Exchanges policy, apply when you visit our store or buy from us. Nothing in these Terms affects your statutory rights as a consumer.

2. Using our store
To buy from us, you must be of legal age in your country of residence. Please make sure the information you give us (such as your email, shipping and billing details) is accurate and up to date. If you create an account, you are responsible for keeping your login details secure.

3. Our products
We work hard to show our pieces as accurately as possible. As a colour-driven brand, please note that colours may look slightly different depending on your screen and device settings. All products are subject to availability, and we may limit quantities per order.

4. Orders
After you place an order, you'll receive an email confirming that we've received it. The contract is concluded when we confirm your order. We may decline an order, for example if an item is out of stock or there is an obvious pricing error; in that case, we'll let you know and refund any payment in full.
You can cancel your order at any time before it is shipped by emailing us.

5. Prices and payment
Prices are shown in euros (€) and include VAT where applicable. Shipping costs are shown at checkout before you pay. Orders delivered outside the European Union may be subject to import duties and taxes, which are the customer's responsibility. The price you pay is the price shown when you place your order. If we notice an obvious pricing error, we will contact you so you can confirm the order at the correct price or cancel it with a full refund.

6. Shipping and delivery
Estimated delivery times are shown at checkout and in our Shipping Policy. Unless agreed otherwise, we will deliver your order within 30 days. The risk of loss or damage passes to you once you, or a person you designate, receive the goods. If your order is late, lost or damaged in transit, contact us and we'll sort it out.

7. Returns, exchanges and right of withdrawal
We offer free returns and free size exchanges within 30 days of delivery, as described in our Returns & Exchanges policy. If you are a consumer in the European Union, you also have the legal right to withdraw from your purchase within 14 days of receiving it, without giving any reason.

8. Legal guarantee
All our products are covered by the legal guarantee of conformity under applicable law. If an item is faulty or not as described, please contact us.

9. Intellectual property
All content in our store, including photographs, designs, texts, graphics and the Love and Its Colors name and logo, belongs to us or our licensors. You may not copy, reproduce or use it for commercial purposes without our prior written permission.

10. Reviews and feedback
If you send us reviews, photos, ideas or other feedback, you allow us to use, publish and share them, free of charge, to operate and promote our store. Please make sure anything you send is your own, is truthful and does not infringe anyone's rights. We may remove content that is unlawful or offensive.

11. Third-party tools and links
Our store may include tools or links provided by third parties. We don't control them and aren't responsible for their content or practices, so please review their terms before using them.

12. Relationship with Shopify
Love and Its Colors is powered by Shopify, which enables us to provide our store to you. However, any sales and purchases you make in our store are made directly with Love and Its Colors. By using our store, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Love and Its Colors, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Love and Its Colors.

13. Privacy
We handle your personal data in accordance with our Privacy Policy. Because our store is hosted by Shopify, some of your data is also processed by Shopify and its partners to provide our services.

14. Acceptable use
Please use our store lawfully. You may not use it to commit fraud, spread malicious code, collect other people's personal data, scrape or copy our content, or interfere with the store's security or operation. We may suspend or close accounts that break these rules.

15. Liability
To the extent permitted by law, we are not liable for indirect or consequential losses arising from the use of our website. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded by law, including your rights as a consumer.

16. Changes to these Terms
We may update these Terms from time to time. The version published on our website when you place your order will apply to that order.

17. Governing law and disputes
These Terms are governed by Portuguese law. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence.
If we can't resolve a complaint together, you may contact an Alternative Dispute Resolution entity: CICAP – Centro de Informação de Consumo e Arbitragem do Porto (www.cicap.pt). More information is available on the Portal do Consumidor (www.consumidor.gov.pt). You may also submit a complaint through the Electronic Complaints Book (www.livroreclamacoes.pt).
